Mental anguish may or may not be induced by mental anguish, depending on a variety of conditions, including the severity and length of the emotional distress. Anger or disappointment can't be compared to the severity of the suffering. Because of the severity of the emotional distress, a mental health diagnosis must be made. In most cases, the court will only consider mental diseases that have been present for at least six months. A patient's eligibility for compensation for mental suffering can be determined with the use of a mental health diagnosis. It must be overturned if the court decides that the defendant put Knussman under emotional pressure in order to overturn the jury's $375,000 verdict in his case. Jurors found proximate cause based on evidence offered by Dr. Toler and his team. In spite of the lack of a clear correlation between emotional distress and constitutional violations, a fair jury's decision may be possible.
